A Lesson on Natural Law, Blackstone to Biden

Two competing theories exist in Jurisprudence:
Evolving Law -vs- Fixed/Natural Law.
Joseph Biden, current VP pick for the Democrats, would have us believe that there are no static standards of law-- that all legal regulations are "evolving."
One of the most quoted legal minds of the founding era, William Blackstone, would call this pure "foolishness." "The fool has said in his heart, there is no God."


William Blackstone, (1723–1780), said this:
"Thus when the Supreme Being formed the universe, and created matter out of nothing, he impressed certain principles upon that matter, from which it can never depart, and without which it would cease to be... This law of nature, being coeval [coexistent] with mankind and dictated by God himself, is of course superior in obligation to any other. It is binding over all the globe, in all countries, and at all times: no human laws are in validity, if contrary to this; and such of them as are valid derive all their force, and all their authority, mediately or immediately, from this original.... Upon these two foundations, the law of nature and the law of revelation [the Bible], depend all human laws; that is to say, no human laws should be suffered [permitted] to contradict these."

This brings to light a pressing battle of worldviews in the area of our legal system. One wordlview claims that our laws are based on unchanging standards as set forth in the Bible, and revealed in natural law, as the founders believed. Another worldview claims that the laws are evolving based on humanistic insight. Biden ascribes to the latter.

In my view, it is of critical importance to elect officials to office who will appoint strict constructionist judges who will simply interpret the Constitution, versus appointing judicial activists. It is the judicial activist justices who feel it is their special role to set the moral framework for our nation by "legislating from the bench." This redefining of the role of the judiciary was regarded as a usurpation [wrongful seizure of power] and an impeachable offense until recently.

Thomas Jefferson said, "To consider the judges as the ultimate arbiters [deciders] of all constitutional questions [is] a very dangerous doctrine indeed, and one which would place us under the despotism [tyranny] of an oligarchy [rule by few]."

Why have we allowed this despotic, wrongful, distribution of powers that we currently have? Please elect candidates who will enforce the rule of law and only appoint strict constructionist judges who will help to return our jurisprudence [legal] system to what the Founders intended.
